Effective Date: September 15, 2026
Last Updated: October 1, 2026

DealerWerx ("DealerWerx," "we," "us," or "our") respects your privacy and is committed to handling personal information responsibly. This Privacy Policy explains what information we may collect when you use the DealerWerx website, mobile applications, marketplaces, services, communication features, payment services, and related features (collectively, the "Platform"), how we may use and disclose that information, and the choices and rights that may be available to you.

This Privacy Policy should be read together with the DealerWerx Terms of Use and any other agreements that apply to particular DealerWerx services.

1. Information We Collect

We may collect information that you provide directly, information generated through your use of the Platform, and information received from other users, service providers, or other sources where appropriate.

Account and Registration Information

When you create or use a DealerWerx account, we may collect information such as your name, contact information, account credentials, and other information you choose to provide. Depending on the service or transaction, we may also request additional information or documentation for account management, verification, fraud prevention, payment processing, or other legitimate purposes.

Marketplace, Listing, and Vehicle Information

When you create, modify, purchase, sell, or otherwise interact with a listing, we may collect the information associated with that activity. This may include descriptions, photographs, videos, pricing, item details, vehicle information, ownership or title information, identification numbers, condition or history information, registration or lien information, and supporting documentation where applicable.

Information contained in a listing may be made available to other users or distributed through DealerWerx services and other permitted channels in accordance with the Terms of Use.

Transaction and Service Information

We may collect information relating to offers, purchases, sales, transaction status, fees, refunds, disputes, chargebacks, consignment activities, and other transactions or services you initiate or participate in through the Platform.

User Content and Communications

We may collect and process content you submit or transmit through the Platform, including listings, photographs, videos, reviews, ratings, comments, questions, feedback, messages, and other communications.

DealerWerx may retain, process, review, moderate, or disclose communications where reasonably necessary to provide services, investigate suspected abuse or fraud, protect users or the Platform, enforce our agreements, or comply with legal obligations. Accordingly, communications made through DealerWerx should not be assumed to be completely private from DealerWerx.

Payment Information

Payments may be processed by DealerWerx or by third-party payment providers. Depending on the payment method and service used, information may be shared with payment processors and other service providers to authorize and process payments, complete transactions, provide refunds, manage chargebacks or disputes, prevent fraud, perform verification, and satisfy legal or regulatory requirements.

Where a third party processes payment information directly, that provider's privacy practices may also apply.

Location and Map Information

Certain DealerWerx features may use location-related information for maps, location-based searches, approximate locations, meeting locations, distance calculations, directions, or related services. Location information may be obtained from DealerWerx, mapping providers, device services, or other permitted sources, and some features may require applicable device permissions.

Reviews and Ratings

If you submit reviews, ratings, or similar content, that information may be displayed to other users and associated with your account or other information made available through the Platform.

2. How We Use Information

We may use information we collect to provide, operate, maintain, and improve the Platform and its features; create and manage accounts; facilitate listings, communications, purchases, sales, payments, consignment services, subscriptions, and other transactions; provide customer support; process and respond to requests; send service and transaction communications; administer fees and subscriptions; prevent fraud, abuse, unauthorized activity, and security incidents; investigate disputes and enforce our agreements; comply with applicable legal or regulatory obligations; and protect the rights, property, safety, and security of DealerWerx, our users, and others.

We may also use information for internal operations, service improvement, security, analytics, administration, and other purposes reasonably related to providing and operating the Platform.

3. Information Made Available Through the Platform

Some information is intended to be visible or accessible to other users as part of the Platform. This may include information contained in marketplace listings, reviews, ratings, seller or buyer information, communications necessary to facilitate transactions, and other information you choose to make available.

You should consider carefully what personal information you include in listings, messages, reviews, or other content because information shared with other users may be copied, retained, or used by recipients outside DealerWerx's control.

4. Listing Distribution and Promotion

DealerWerx may display, distribute, promote, or syndicate listings and related content through DealerWerx websites, applications, services, partners, advertising channels, search services, and other permitted distribution channels in order to operate and promote the Platform and facilitate transactions.

The information included in publicly or broadly distributed content may therefore be accessible beyond the specific DealerWerx page or application where it was originally submitted.

5. Third-Party Service Providers

DealerWerx may use third-party service providers to support the Platform and its services. Depending on the service involved, these providers may include payment processors, identity or verification providers, mapping providers, communication providers, hosting providers, analytics providers, technology providers, and other service providers.

We may share information with these providers when reasonably necessary for them to perform services on our behalf, support transactions, provide requested functionality, prevent fraud, maintain security, comply with legal requirements, or otherwise support DealerWerx operations.

Third-party providers may have their own privacy policies and terms governing their handling of information.

6. Apple, Google, and Other Platform Services

If you use DealerWerx through services provided by Apple, Google, or another third party, certain information may be processed by those providers in connection with their services, including app distribution, subscriptions, payments, authentication, or related functionality.

For example, purchases or subscriptions made through the Apple App Store or Google Play may be subject to the applicable provider's payment, subscription, and privacy practices in addition to DealerWerx's practices.

7. Fraud Prevention, Security, and Abuse

DealerWerx may use information to detect, investigate, prevent, and respond to fraud, unauthorized transactions, account misuse, security incidents, prohibited activities, abuse, and other activity that may harm users or the Platform.

We may share relevant information with payment providers, verification providers, service providers, other users where appropriate, legal authorities, or other parties when reasonably necessary to investigate or address these matters or protect people, property, rights, or security.

8. When We May Disclose Information

We may disclose information:

  • to service providers and technology partners supporting DealerWerx;

  • to other users when disclosure is part of a requested marketplace, transaction, communication, listing, review, or other Platform activity;

  • to payment, verification, fraud-prevention, or other providers when necessary to provide requested services;

  • when required or permitted by applicable law, regulation, legal process, court order, or governmental request;

  • when reasonably necessary to protect the rights, safety, property, or security of DealerWerx, users, or others;

  • to investigate suspected fraud, abuse, security incidents, or violations of our agreements; or

  • with your direction, consent, or authorization where appropriate.

DealerWerx does not disclose information more broadly than reasonably necessary for the applicable purpose, subject to applicable law and the operation of the Platform.

9. Business Transfers

If DealerWerx is involved in a merger, acquisition, financing, restructuring, reorganization, sale of assets, corporate transaction, or similar event, information associated with the Platform or its users may be transferred or disclosed as part of that transaction, subject to applicable law.

10. Data Retention

We retain information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide services, maintain business and transaction records, resolve disputes, enforce agreements, prevent fraud and abuse, maintain security, and comply with legal or regulatory obligations.

The appropriate retention period may vary depending on the type of information, the nature of the relationship with DealerWerx, the purpose for which the information was collected, and applicable legal requirements.

11. Account Closure and Deletion

You may request closure of your DealerWerx account or deletion of information where such options are available and permitted by applicable law.

Closing an account or requesting deletion does not necessarily result in immediate deletion of all information. Certain information may need to be retained for legitimate business purposes, transaction records, fraud prevention, security, dispute resolution, legal obligations, or other purposes permitted by law.

Information that has already been shared with other users or incorporated into transactions, records, or other content may also remain available where retention is permitted or required.

12. Information Security

DealerWerx takes reasonable measures designed to protect information against unauthorized access, use, alteration, disclosure, or destruction. However, no website, application, communication system, or method of electronic storage or transmission can be guaranteed to be completely secure.

You are responsible for maintaining the confidentiality of your account credentials and for notifying DealerWerx if you believe your account or credentials have been compromised.

13. Communications and Marketing

DealerWerx may send communications necessary to operate your account or provide services, including account notifications, transaction confirmations, payment receipts, security alerts, service notifications, subscription notifications, legal notices, and communications relating to activity on the Platform.

Where permitted by applicable law, DealerWerx may also send promotional or marketing communications. You may have the ability to manage certain marketing communications through the available preferences or unsubscribe mechanisms. Service-related and legally required communications may continue even if you opt out of promotional communications.

14. Information About Other People

If you provide DealerWerx with information about another person, you are responsible for ensuring that you are authorized to provide that information and that doing so does not violate applicable law or another person's rights.

You should not provide another person's personal information to DealerWerx unless you have a lawful basis or appropriate authorization to do so.

15. Business and Organizational Users

If you use DealerWerx on behalf of a business, dealership, organization, or other entity, information provided or generated through that use may be associated with the relevant organization and may be subject to the organization's own policies, agreements, or administrative practices.

You are responsible for ensuring that your use of the Platform and any information you provide on behalf of an organization is authorized.

16. Children and Minors

DealerWerx is not intended for use by individuals who are not legally permitted to use the Platform under applicable law. We do not knowingly seek to collect personal information from children in violation of applicable legal requirements.

If you believe that a child has provided personal information to DealerWerx in circumstances where such collection is not permitted, please contact us so that the matter can be reviewed and addressed as appropriate.

17. Your Privacy Rights

Depending on where you live and the laws that apply to you, you may have rights relating to your personal information. These may include rights to request access to information, request correction of inaccurate information, request deletion where legally available, object to or restrict certain processing, withdraw consent where processing is based on consent, or request information about how your personal information is handled.

The privacy rights and obligations applicable to you may depend on your location, the nature of your relationship with DealerWerx, and the specific processing involved.

19. Third-Party Links and Services

The Platform may contain links to, integrations with, or references to third-party websites, applications, products, or services. DealerWerx does not control the privacy practices of third parties that operate independently from DealerWerx.

Your interactions with those third parties may be governed by their own privacy policies, terms, and practices. You should review those policies before providing personal information to a third party.

DealerWerx may update this Privacy Policy from time to time to reflect changes to the Platform, services, legal requirements, business practices, or other circumstances.

When changes are made, the updated version will be posted through the Platform with an updated "Last Updated" date. Where required by applicable law, DealerWerx will provide additional notice or obtain consent for material changes.
